1. Acceptance of Terms

By accessing or using Shorty ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Shorty provides URL shortening services with analytics, custom domains, QR code generation, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities under your account
• Not share your account credentials with others

You must be at least 13 years old to use the Service.

4. Acceptable Use Policy

You agree NOT to use Shorty to:

• Violate any laws or regulations
• Share illegal content (malware, viruses, illegal materials)
• Engage in phishing, scams, or fraud
• Distribute spam or unsolicited messages
• Harass, abuse, or harm others
• Infringe on intellectual property rights
• Impersonate others or misrepresent affiliations
• Attempt to hack, disrupt, or overload our systems
• Circumvent our security measures
• Scrape or extract data without permission

We reserve the right to investigate violations and suspend or terminate accounts that violate these terms.

5. Intellectual Property

Our Rights: Shorty and its original content, features, and functionality are owned by Shorty and are protected by international copyright, trademark, and other intellectual property laws.

Your Rights: You retain all rights to the URLs and content you shorten. By using our Service, you grant us a limited license to host and display your links as necessary to provide the Service.

6. Payment and Subscriptions

For paid plans:

• Billing: You'll be charged according to your selected plan
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Cancellation: You may cancel anytime; cancellation takes effect at the end of the current billing period
• Refunds: Refunds are provided at our discretion and subject to our refund policy
• Price Changes: We may modify prices with 30 days' notice to existing subscribers
• Taxes: Prices don't include applicable taxes unless stated

7. Data and Analytics

When users click your shortened links, we collect analytics data as described in our Privacy Policy. You acknowledge that this data is aggregated and may be used to improve our Service. You're responsible for complying with applicable privacy laws when using our analytics features.

8. Service Availability

While we strive for 99.9% uptime, we don't guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We're not liable for any losses resulting from service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Shorty and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Illegal or harmful activity
• Extended inactivity
• At your request

Upon termination, your right to use the Service will immediately cease. Your shortened links may continue to redirect for a limited time at our discretion.

13. Governing law and venue

These Terms shall be governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), where applicable.

If you are a merchant (Kaufmann) within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Berlin, Germany. In all other cases, applicable statutory jurisdiction applies, including mandatory consumer jurisdiction under EU or national law where you qualify as a consumer.

14. Dispute Resolution

Most disputes can be resolved informally by contacting us at support@shorty.com. If we can't resolve a dispute within 60 days, either party may pursue formal resolution. For disputes under $10,000, we both agree to binding arbitration.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We'll notify users of significant changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

16. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and Shorty.

Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.

Waiver: No waiver of any term shall be deemed a further or continuing waiver.

Assignment: You may not assign these Terms without our consent. We may assign our rights to any affiliate or successor.
